Medical Lawyers FAQs
The main purpose of medical lawyers is to represent their clients in cases where injuries have occurred. It doesn’t matter if the injury occurred from malpractice or a hospital error.
A medical lawyer will work to ensure their client comes out on top. Medical lawyers do the same things that other lawyers do, but their work focuses on the medical side. Here are the main things they do in a case:
One of the most important things a med lawyer does is collect evidence about the case. When you present your case to them, they’ll start speaking with witnesses and ask about what happened. If your injury occurred in a public setting, they’d ask local business owners if they have surveillance of the event.
If your lawyer manages to get video evidence of the injury, the likelihood that you’ll win your case increases a lot. A med lawyer will also get the defending party’s side of the story to see if it aligns with yours. If the defendant is also working with a lawyer, they’ll most likely avoid saying much.
Work With Client
While the medical lawyer is gathering evidence, they’ll work with their client to develop a case that will convince the court. First, the lawyer will ask the client what happened and ensure they know their rights.
Then, they’ll go with the client to acquire medical records and get an expert opinion from a doctor about the injury. These will be used as evidence during the case, and it allows the client to learn more about their injury aside from their initial visit.
Represent Client in Court
In court, the lawyer will be the one that does most of the talking. This is because they have a better way with words when it comes to the law, so they’ll get the point across much clearer. They’ll present the evidence and argue why you should be compensated for your injuries.
Whenever the defendant is arguing their side of the event, a lawyer will object to anything said if it can’t legally be used as evidence. Med lawyers will also prepare their clients for when the judge wants them to speak.
I do not mean fear or weakness by humility, but a realistic understanding that medical malpractice litigation is supremely difficult and requires utmost skill and ability. If some lawyer talked to me about “slam dunks,” “big checks,” or any other variation of the “show me the money” attitude, I would run the other way–fast.
For clients and the lawyers they hire, medical litigation is stressful and relentless. The defence is well-funded, smart, and they never stop defending. In the face of such an enemy, it is easy to get discouraged and overwhelmed (like most Israelites did when they saw Goliath).
Confident courage is the other side of humility. A lawyer who understands and is realistic about what he is facing but willingly faces it because he believes in himself (confidence, not arrogance) is the lawyer for me.
A frequent pattern I see in medical malpractice cases is the doctor who doesn’t listen to his patient and consequently doesn’t hear the key information necessary to an accurate diagnosis.
Lawyers are the same way. The client is the most important person in any legal case. A lawyer who interrupts me, tells me what I’m thinking (or worse, what I’m feeling), or who sees me as a case instead of a client is not a lawyer I want.
Telling my story is the other side of patiently listening to me. If, after telling him what happened to me, a lawyer cannot re-frame the events into a story that all people can relate to, then he cannot handle a medical case.
For example, a doctor making the wrong diagnosis is almost always about him not paying attention–something everyone understands–rather than failing to memorise or recognise signs and symptoms from a medical textbook. A lawyer who cannot see the difference will never be my lawyer.
I agree that having money is not a character as it is a circumstance, but it cannot be ignored. Not only is medical malpractice litigation complex and difficult, but it is also darn expensive when done right.
Hiring quality experts, running focus groups, creating top-notch trial exhibits all cost money, and if the lawyer who wants my case doesn’t have the means (i.e., the money) to do these things, he is not the right lawyer. Sorry, but ability without means is like a sports car without gas.
Accelerate the Process
A good medical malpractice attorney understands that time is of the essence. They also recognise that your time is valuable and is better spent moving on with your life rather than dwelling on this traumatic event. As a result, they will work diligently to speed up your legal proceedings and get you a settlement as soon as possible.
Boost Your Chances of Getting an Award
A medical malpractice lawyer boasts a high degree of expertise that can improve your chances of winning your case and receiving compensation. Not only will they have a better insight into the value of your claim, but they are expert negotiators, so they can skillfully build a case as to why you should get that amount of money – and maybe even more.
Negotiating With Insurance Companies
It’s no secret that dealing with insurance companies can be an absolute hassle. It can also be intimidating – you may be unsure whether you have to talk to them and what to say. However, as someone already suffering from a painful injury or illness and emotional trauma, engaging in a back-and-forth with insurance companies is the last thing you should be worried about.
When you hire a medical malpractice attorney, they handle these matters for you as it’s one of the key components of their job description. In addition, they correspond with insurance companies on your behalf and inform you of what to say and what not to say if you do have to speak to an insurance agent yourself.
Peace of Mind
You can’t put a price on your peace of mind. So when you hire a medical malpractice lawyer, you’ll rest easy knowing your case is in the best hands. With their help, you won’t have to worry about navigating the complexities of the legal system on your own. Instead, you’ll have a trusted consultant in your corner providing guidance and support every step of the way. Having that kind of ally on your side is an invaluable asset in any medical malpractice proceeding.
If you have suffered from an injury or illness due to a healthcare professional’s negligence, you could be entitled to compensation. When you hire a medical malpractice attorney, you take the first step in securing both the awards and the justice you deserve. The sooner you recruit a medical malpractice lawyer to help you with your case, the sooner you can get back to living life on your terms.
An Upper Hand When Dealing With Insurance Companies.
One of the most overwhelming and most intimidating aspects of going through a medical malpractice claim is dealing with insurance companies. The average person doesn’t know the legal requirements as far as when they should or should not talk to the insurance company and what they should and should not disclose.
Handling All the Document Filing, Record Keeping and Endless Paperwork.
If you have read any legal terms or contracts, you know how frustrating legal jargon can be and how easily you can become confused within just a few lines of text. In a medical malpractice claim, you will have to deal with an almost never-ending stream of paperwork, including a form to fill out, sign, read, file, and respond to.
An Attorney Will Fully Understand the Value of Your Malpractice Claim.
Without reference points and other similar cases to yours to consider, it can be difficult to know what your case is worth and how much you should be seeking in terms of compensating for your injuries.
Attorneys who are experienced with medical malpractice cases have been through the process many times. They know how to place value on the case, your injuries, your loss of life quality, and all the other factors that must be considered.
Negotiating Compensation and Getting the Best Settlement Possible.
Along with knowing what a claim is worth, attorneys, in general, are skilled at negotiating, and this is particularly true for malpractice attorneys. In many cases, an attorney’s reputation precedes them, which means you want someone known and respected for being fair and tough and for winning their cases.
Avoiding Mistakes That Could Cost You Your Ruling.
If you are not familiar with and comfortable with the process of filing a claim, defending your case, and arguing your side, it is going to be more likely that you will make mistakes.
When you’re dealing with a medical malpractice claim, there is a lot at stake. Everything from lost wages, medical care costs, lost quality of life, and other factors all play into your case and mean each one is an opportunity to make a misstep.
Speeding Things up and Saving You Time in the Court Room.
A good attorney who has seen their fair share of medical malpractice cases is something who will appreciate the gravity of the situation for their client. They know full well that time is often of the essence for their clients as medical bills loom, treatments need to be paid for, and life’s expenses don’t wait for an injury to heal.
Tapping Into Resources That Might Not Be Available Elsewhere.
When you hire an attorney who has experience with medical cases, you are doing more than just choosing someone to represent you in the courtroom. You are also enlisting the help of their connections and are gaining access to the resources and tools, and information that would not be otherwise available to you.
Type of Lawyer
Medical malpractice attorneys normally fall into one of two categories:
- Lawyers who represent individuals injured by medical malpractice (plaintiff’s lawyers), and
- Lawyers who defend doctors or insurance companies.
If you suffered injuries due to medical malpractice, you would likely need a plaintiff’s lawyer to represent you.
Make sure that you do some research before you choose an attorney for your case. A quick internet search for medical malpractice attorneys in your area will likely yield a variety of results.
Don’t be afraid to browse a few websites or call some firms directly to ensure that you select a plaintiff’s lawyer who can effectively represent you and your particular interests.
Lawyers with experience in medical malpractice lawsuits will understand the relevant law and have familiarity with standard medical procedures and practices.
While researching, look for attorneys or law firms that concentrate on medical malpractice. Read their biographical information, and search their website for articles or blog posts related to medical malpractice. If these articles appear informative and helpful, this likely means they have a practice focused on medical malpractice.
Professional Reputation and Client Reviews
An attorney’s professional reputation will provide you with important insights into their ability to win a case. Not only do medical malpractice attorneys with strong reputations in the legal community have experienced, but their experience has also gained the respect of their peers.
You should look for lawyers who belong to trial attorney associations and learn whether they have received awards or hold leadership positions in those organisations.
History of Success
You want to focus your research on medical malpractice lawyers with a proven track record of success. Experience and reputation are important, but they do not always show whether an attorney is successful when representing clients.
You should keep in mind that attorneys will charge fees for legal services. The primary fee arrangements that an attorney might charge in a legal case include:
- Hourly rates,
- Flat fees, and
- Contingency fees.
One drawback for many people in deciding whether to hire an attorney is the potential cost. Under an hourly arrangement where you are paying for every hour of an attorney’s time, legal representation can get very expensive very fast.
Conversely, a flat fee arrangement is sometimes preferred over an hourly arrangement, as you will know your payment obligation upfront. However, in a medical practice case, where issues are complex and reaching a resolution can take months and even years, many attorneys will not likely offer a flat fee.

A Brief History
Galbally & O’Bryan has built its success on generations of Australia’s best legal practitioners. Decades of knowledge, skill and passion for the law have made Galbally & O’Bryan what it is today.
Our firm was founded in 1935 by John Galbally, who was later joined by his brother, Frank, in 1948. John pursued a distinguished and longstanding career in state politics and was a renowned social reformer, most notably campaigning against capital punishment. He was appointed Queen’s Counsel (QC) in 1968.
In 1965, Frank Galbally went into partnership with Peter O’Bryan, a leading personal injury lawyer. Frank was regarded by many as the preeminent criminal lawyer of his time. He was one of the first solicitors to practise as a trial advocate without joining the Victorian Bar and was famous for a remarkable acquittal rate.
Our criminal law practice is now managed by Paul Galbally and Peter Ward, criminal law specialists with over forty years of experience between them. They have been involved in some of the most significant inquiries and criminal law cases in Australia.
In the 1960s, Galbally & O’Bryan began making personal injury claims on a ‘no win – no charge basis. This arrangement continues today and has enabled many clients who might not otherwise be able to afford a lawyer, to pursue compensation claims.
Since 1994 Galbally & O’Bryan has been one of the few Victorian law firms to employ a qualified medical practitioner/lawyer to provide specialised advice to assist in personal injury matters.
Over the years, we have built on our proud heritage, providing ethical and expert legal services and access to justice for all our clients. We have always been committed to providing legal assistance to all persons in deserving cases, regardless of their financial means.
With our reputation for excellence, we attract the best legal minds in the country. Leading members of the legal community who have worked at our firm include a former Premier of Victoria, a former Chief Justice of the Supreme Court, a Chief Justice of the County Court, many current QCs and SCs and several serving Supreme Court and County Court Judges.
Maurice Blackburn - Medical Lawyer Melbourne

Get to Know Your Melbourne Lawyers
Our founder, Maurice Blackburn, opened the first office in Melbourne in 1919, and we have been fighting to protect the rights of everyday Australians ever since. We are a passionate team and always ensure the best possible results for each and every client.
Our Melbourne lawyers are proud to work with Victorians who might otherwise not have access to the courts. We have clients from a diverse range of cultural backgrounds, languages and traditions, who all deserve to be heard and represented.
We offer legal services across a number of areas of law, including:
- Personal injury
- Workplace injury compensation
- Motor vehicle claims
- Superannuation and insurance claims
- Medical negligence
- Wills and estates
Fighting for Your Rights Since 1919
For over 100 years, our Melbourne lawyers have been working to hold people and corporations accountable for wrongdoing and ensuring that those harmed are properly compensated. We have been involved in high-profile social justice cases which have challenged the excesses of government and business and put the power back into the hands of those who have been disadvantaged.
- In 1945, we worked with the ACTU and won the claim for a 40-hour workweek.
- Throughout the 1950s and 1960s, we collaborated with unions to fight for equal wages for women until equal pay finally became law in 1972.
- In 1966, we acted on behalf of the North Australian Workers Union to win the landmark Northern Territory Cattle Industry case.
To this day, we are still achieving life-changing results for clients who have been seriously affected by injustice. In 2017, we distributed $700 million to survivors of the Black Saturday bushfires following the biggest class action settlement in Australian history.
We Fight for Fair.
Maurice Blackburn is proud to be Australia’s leading social justice law firm. We’ve built a reputation on the unwavering belief that the law should serve everyone, not just those who can afford it.
That’s why we’re here for everyday Australians who deserve to have their rights defended, people who deserve:
- The right to be free – to live without the threat of persecution or oppression.
- The right to feel safe – to live and work without physical or emotional threats.
- The right to be heard – to not be silenced by the wealthy, privileged or powerful.
- The right to equality – to be respected as human beings and free from prejudice.
In 1919, Maurice Blackburn – a man whose sense of civil liberty was ahead of his time – set the course for social justice in Australia. In the time since, his law firm has contributed to some of Australia’s most influential legal decisions, from the 40-hour week and equal pay for women and Indigenous workers to the fight against patenting of human genes and the largest class action settlement in Australian history. And the legacy grows as we continue to protect the exploited, free the wrongfully detained and hold the big names to account. Although we’ve been leading the charge for almost a century now, as far as we’re concerned, the fight for the fair has only just begun.
Today, Maurice Blackburn is a national firm with over 30 offices throughout Australia and more than 1000 of the country’s best and most respected legal professionals. We provide accurate and confidential advice without unnecessary legal jargon, and we recognise the varying financial circumstances of our clients and offer a flexible fee policy. We treat every client who walks through our door with the sincerity and respect they deserve.

Gerard Malouf & Partners - Medical Lawyer Melbourne

Our Difficult Case Policy
At Gerard Malouf & Partners, we have introduced a policy that if any case appears to be overly difficult or unlikely to obtain a good result for the client, our lawyers must bring it to the attention of the management team via a detailed pro-forms explanation early and then our management team will take all steps possible to ensure it is successful and that we obtain the maximum result for the client.
This is unlike other law firms who often run compensation claims in a mechanical way. At Gerard Malouf & Partners, our compensation claims services handle each claim thoroughly and comprehensively prepare it in every aspect.
This is more tedious, more complex and costlier for our firm in some ways, but the best result will be achieved every time for our clients seeking accident injury compensation service. It is our professional obligation to strive not just for some justice but for the maximum achievable. This is our core philosophy and what differentiates us from other law firms.
We Are Different, Why Are We Better?
Gerard Malouf & Partners started with a baptism of fire that aggressively took on insurance companies and groups that had seized power against individuals who needed redress due to tough anti-Plaintiff laws being introduced by the government.
Our aim continues to be the absolute best, most highly specialised Personal Injury Law Firm in Australia, no ifs or buts. In our law firm, mediocrity and an average approach to work have no place, and we pride ourselves on our exceptional client service!
Critical to success is our triple “C” attitude – Compassion, Commitment and Competence. All members of Gerard Malouf & Partners share this attitude to ensure each client achieves the maximum result in the quickest possible time against the odds.
All our staff and particularly our Gerard Malouf & Partners lawyers love being part of the family because our work involves multiple specialisations and our track record helping often distraught and disadvantaged people achieve their hopes and dreams with maximum justice in a compassionate manner, often against the odds.
We consider ourselves to be legal surgeons with a life-threatening operation to perform – with our desk being the operating table.
What we have achieved is fantastic, but what excites and drives us is the future and what we can achieve, where we will be and where we are heading so that we can improve on anything that we have achieved in the past for clients.
Our lawyers and staff have achieved through hard-earned litigation the gift of knowledge to help our clients work their way through complex laws to achieve maximum justice.
With this ability comes great responsibility with serious obligations to society and our clients! Let’s never forget that as we can individually change the impact and extent of laws and their application through every case that we are involved.
Our aim at Gerard Malouf & Partners is that in every case that we handle, we regard it as being our first and only matter and strive unreservedly with a passion for achieving extraordinary results looking outside the standard parameters, not adopting the standard assumptions that most lawyers might assume to speed up processes, but examining each and every facet of liability and damages so that we can explore and maximise our client’s entitlements, never assuming or approaching a case with a cookie-cutter attitude.
We are not afraid to seize the extraordinary power that we can wield to achieve the perfect result.
With direction from our clients, we have the power to control outcomes and don’t simply rely on barristers, doctors or professional experts that we engage without thoroughly analysing, criticising, probing and questioning every aspect of a claim for the benefit of our clients until we are satisfied we are taking the appropriate direction to achieve justice and maximum damages.
We are not just after mediocre average results that many other law firms achieve but extraordinary results!
The core philosophy of Gerard Malouf & Partners and the essence of our business structure makes it a far more dynamic, satisfying and exciting place to work due to the fact that there is no place for mediocrity or the word “average” here.
We are always striving for greatness and excelling at everything from client care, showcasing the “love” and triple “C” attitude – Compassion, Competence and Commitment to our clients and excelling with brilliant, incisive legal preparation and presentation.

- Medical Negligence: Have you been injured as a result of negligent medical advice or treatment? You may be able to claim for damages as you have a reasonable expectation to receive correct treatment from trained medical practitioners.
- Class Actions: We represent ordinary Australians who have suffered injury and loss. When the actions of an individual, corporation or other entity have impacted many people or entire communities, we can take action on behalf of the entire group to ensure justice is served.
- Product Liability: Injured by a defective or unsafe product? You may be able to claim damages as manufacturers and retailers have a legal responsibility and duty of care to sell safe products.
- Birth Injury: You and your child may be entitled to compensation if your child was injured during birth. Our personal injury lawyers understand this is a difficult and highly sensitive time and will work with your family with the proper professionalism and compassion to assist in recovering compensation so your family can move forward.
- Asbestos Claims: You may be entitled to compensation if you have been exposed to asbestos products and have suffered an injury.
